In-substance defeasance refers to a financial arrangement where a debtor effectively removes a liability from its balance sheet without legally extinguishing it. This is achieved by setting aside sufficient assets in a trust to cover future payments, thus ensuring the liability is economically, though not legally, settled. In substance defeasance is often used in debt restructuring and refinancing scenarios.
